Arbicle is a listing platform — not a landlord, letting agent, or property manager.
We connect landlords and prospective tenants but are not a party to any rental agreement. Arbicle does not own, manage, inspect, or verify any property listed on this platform. All rental transactions, agreements, and obligations are solely between the landlord and tenant. Arbicle accepts no responsibility for the conduct, accuracy of listings, or compliance of any user.
1. Introduction
Welcome to Arbicle (“we”, “our”, “us”). Arbicle Ltd is a company registered in Ireland with its registered office at 1 Grand Canal Square, Dublin 2, D02 P820.
These Terms of Service (“Terms”) govern your access to and use of the Arbicle website (the “Platform”). By creating an account or using any part of the Platform you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
Arbicle is an online marketplace and listing platform only. We are not a landlord, property manager, estate agent, or letting agent. We do not own or control any properties listed on the Platform. We do not select tenants, draft lease agreements, collect rent, or manage tenancies on behalf of any user.
2. User Accounts
To access certain features you must register for an account. You must provide accurate, current, and complete information during registration and keep your information up to date. You are responsible for safeguarding your password and for all activity that occurs under your account.
You must notify us immediately at hello@arbicle.com upon becoming aware of any unauthorised use of your account.
You must be at least 18 years old to create an account.
3. Use of the Platform
You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform:
- In any way that violates applicable Irish or EU law or regulation.
- To transmit unsolicited or unauthorised advertising or promotional material.
- To impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- To engage in any conduct that restricts or inhibits anyone's use of the Platform.
We reserve the right to terminate or suspend your access at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
4. Listings — User Responsibility
Landlords and property managers (“Listers”) may post rental listings on the Platform subject to our Listing Guidelines and Landlord Terms.
You, as the Lister, are solely responsible for your listing and its content. By posting a listing you represent and warrant that:
- You are the legal owner or authorised agent of the property.
- All information in the listing is accurate, complete, and not misleading.
- The property complies with all applicable health, safety, and planning regulations.
- The rental price complies with Rent Pressure Zone (RPZ) legislation where applicable.
- You have satisfied, or will satisfy, all applicable landlord obligations under Irish law, including tenancy registration requirements.
Arbicle does not verify the accuracy of listings, the identity of Listers, or whether any property complies with applicable law. Arbicle publishes listings in good faith based on information provided by users and does not warrant or guarantee that any listing is accurate, lawful, or available.
We reserve the right to remove or edit any listing that, in our sole judgement, violates these Terms, our Listing Guidelines, or applicable law.
5. Rental Compliance — Landlord Disclaimer
Arbicle is a listing platform and is not responsible for ensuring landlord compliance with Irish rental law. Landlords are solely responsible for complying with all applicable legislation, including but not limited to:
- Residential Tenancies Act 2004 (as amended).
- Rent Pressure Zone (RPZ) rent restrictions.
- Minimum standards for rental accommodation (SI 137 of 2019).
- Building Energy Rating (BER) requirements.
- Tenancy registration obligations with the Residential Tenancies Board (RTB).
- Notice period requirements for termination.
- Equal Status Acts 2000–2018 (prohibition on discrimination, including HAP).
Arbicle does not enforce, verify, or guarantee that any landlord on the Platform has registered their tenancy with the RTB or complied with any other legal obligation. Renters are encouraged to ask landlords to confirm their RTB registration status directly. For information on your rights as a tenant or landlord, visit rtb.ie.
6. Payments & Fees
Arbicle charges a platform fee of 1.5% of the first month's rent for each successfully completed letting facilitated through the Platform. Payments are processed via Stripe. By using the payment features you agree to Stripe's Terms of Service.
All fees are quoted inclusive of VAT at the applicable Irish rate. Arbicle reserves the right to change its fee structure upon 30 days' written notice.
Arbicle does not hold security deposits. Any security deposit arrangements are made directly between landlord and tenant and are subject to the Residential Tenancies Act 2004 (as amended).
7. Prohibited Conduct
The following conduct is strictly prohibited on the Platform:
- Posting fraudulent, misleading, or phantom listings.
- Discriminating against prospective tenants on any ground prohibited by the Equal Status Acts 2000–2018, including housing assistance (HAP) recipients.
- Demanding or accepting payments outside the Platform in circumvention of Arbicle fees.
- Scraping, crawling, or data-mining the Platform without our written consent.
- Introducing malware, viruses, or other harmful code to the Platform.
- Engaging in any form of harassment, abuse, or threatening behaviour toward other users.
Violations may result in immediate account suspension, removal of listings, and referral to An Garda Síochána or other relevant authorities where appropriate.
8. No Liability for User Disputes
Arbicle is not responsible for resolving disputes between landlords and tenants. Any dispute arising from a tenancy — including but not limited to deposit disputes, property condition disagreements, lease terms, rent arrears, or eviction — is a matter between the landlord and tenant and must be addressed through the appropriate channels, including the Residential Tenancies Board (RTB) dispute resolution service at rtb.ie.
Arbicle does not act as mediator, arbitrator, or adjudicator in any landlord-tenant dispute. We have no authority or obligation to enforce the terms of any rental agreement and are not a party to any such agreement.
Arbicle will cooperate with RTB, court orders, and lawful requests from An Garda Síochána where required.
9. Intellectual Property
The Platform and all content and materials therein, including but not limited to text, graphics, logos, and software, are the property of Arbicle Ltd or its licensors and are protected by Irish and EU intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by Irish law, Arbicle Ltd and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform.
In particular, Arbicle accepts no liability for:
- The accuracy, completeness, or legality of any listing published by a user.
- Any landlord's failure to comply with Irish rental law, including RTB registration.
- Any dispute arising between a landlord and tenant, including deposit disputes or tenancy terminations.
- Any loss or damage arising from your reliance on information published on the Platform.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the fees paid by you to Arbicle in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law.
11. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Ireland. The courts of Ireland shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.
These Terms do not affect any statutory rights you may have as a consumer under Irish and EU consumer protection law, including the Consumer Rights Act 2022 and the EU Consumer Rights Directive.
In compliance with EU Regulation 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Our email address for ODR purposes is hello@arbicle.com.
Personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR) as enacted in Irish law by the Data Protection Act 2018.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes we will notify you by email or by a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after that date constitutes acceptance of the revised Terms.
